Terms and Conditions

  1. Agreement By purchasing the software CRM, messaging app, email marketing campaign, SMS text messaging system, and site funnel (from now on referred to as “Grow Engine software”), you (from now on referred to as “the Client”) agree to be bound by the terms and conditions outlined in this Agreement. This Agreement is entered between the Client and the software provider (from now on referred to as “the Provider”).
  2. Scope of Services The Provider agrees to provide the Grow Engine software, which includes a CRM, messaging app, email marketing campaign, SMS text messaging system, and site funnel, to the Client. The Grow Engine system is intended to assist the Client in growing their small business and enhancing their marketing efforts.
  3. License and Ownership, The Provider grants the Client a non-exclusive, non-transferable permission to use the Grow Engine software for the Client’s internal business purposes only. The Client acknowledges that the Provider retains all ownership rights, title, and interest in the Grow Engine software, including intellectual property rights.
  4. Payment The Client agrees to pay the Provider the agreed-upon fees for the Grow Engine software as outlined in the invoice provided by the Provider. Payment terms and methods will be specified in the invoice. Failure to make timely payments may result in suspending or terminating access to the Grow Engine software.
  5. Support and Maintenance The Provider will provide reasonable technical support and maintenance for the Grow Engine software during the term of this Agreement. The Client may contact the Provider’s support team for assistance with any issues or inquiries related to the Grow Engine software.
  6. Data Security and Confidentiality, The Provider will implement reasonable security measures to protect the Client’s data stored within the Grow Engine software. The Provider agrees to treat all data and information provided by the Client as confidential and will not disclose or share it with any third parties except as required by law.
  7. Limitation of Liability, The Client acknowledges that the Grow Engine software is provided on an “as-is” basis, and the Provider makes no warranties or representations regarding its functionality or performance. The Provider shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Grow Engine software.
  8. Termination, Either party may terminate this Agreement upon written notice to the other party. In the event of termination, the Client shall no longer have access to the Grow Engine software, and any outstanding fees shall become immediately due and payable.
  9. Governing Law and Jurisdiction, This Agreement shall be governed by and construed by following the laws of Fort Bend County, TX. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Fort Bend County, TX.
  10. Entire Agreement This Agreement constitutes the complete understanding between the Client and the Provider. It supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
  11. By proceeding with purchasing and using the Grow Engine software, the Client acknowledges that they have read, understood, and agreed to be bound by these terms and conditions.
